TERMS AND CONDITIONS

ICC Sports Academy L.L.C. S.P.C. – International Chess Club – Participation, Activities, Media, Payments, Liability, and Legal Framework

  1. Binding Agreement

These Terms and Conditions (“Terms”) constitute a legally binding agreement between the ICC Sports Academy L.L.C. S.P.C. International Chess Club (“the Club”) and the parent or legal guardian (“Guardian”) of the participant (“Participant”).

By completing registration, the Guardian confirms that they have read, understood, and accepted these Terms in full, without limitation or reservation. Acceptance is mandatory for participation.

Electronic acceptance constitutes a legally valid signature with the same legal effect as a handwritten signature.

  1. Scope of Application

These Terms apply to all Club-related activities, including but not limited to:

  • chess lessons and training sessions
  • tournaments and competitions
  • camps, workshops, and events
  • online activities and digital platforms
  • use of Club facilities and third-party venues
  • Club website, communication channels, and social media
  1. Nature of Services – No Custodial Responsibility

The Club provides chess-related educational and recreational services only.

The Club does not provide childcare, custodial care, supervision equivalent to parental responsibility, or duty of guardianship under any circumstances.

All parental responsibility remains solely and entirely with the Guardian at all times.

  1. Voluntary Participation and Assumption of Risk

Participation is entirely voluntary.

The Guardian acknowledges and accepts that participation involves inherent, foreseeable, and unforeseeable risks, including but not limited to:

  • accidents and injuries
  • health or medical incidents
  • emotional distress
  • property loss or damage
  • incidents involving other participants, spectators, or third parties

All risks are knowingly, voluntarily, and fully assumed by the Participant and the Guardian.

  1. Waiver and Release of Liability

To the fullest extent permitted by law, the Guardian, on behalf of themselves and the Participant, irrevocably waives, releases, and discharges the Club and its: owners, directors, officers, employees, coaches, contractors, volunteers, partners, from any and all claims, demands, actions, damages, losses, or liabilities of any kind, including those arising from alleged negligence.

  1. Limitation of Liability

Under no circumstances shall the Club be liable for:

  • personal injury or death
  • medical expenses
  • loss, theft, or damage of personal property
  • indirect, incidental, consequential, or punitive damages

Any liability, if legally established, shall be strictly limited to the Club’s legal entity and solely to the extent of applicable insurance coverage, if any.

The Club makes no representations or guarantees regarding insurance coverage for participants.

  1. Indemnification

The Guardian agrees to fully indemnify, defend, and hold harmless the Club from any claims, damages, losses, liabilities, costs, or legal expenses arising from:

  • participation in activities
  • Participant conduct or behavior
  • breach of these Terms
  • claims brought by third parties

This obligation survives termination of participation.

  1. Health and Medical Disclaimer

The Guardian confirms that the Participant is medically fit to participate.

The Club does not provide medical services and assumes no responsibility for medical treatment.

Any first aid rendered is discretionary and does not create a duty of care.

All medical costs remain the sole responsibility of the Guardian.

  1. Conduct and Discipline

Participants are expected to behave respectfully and lawfully.

The Club is not responsible for conflicts, misconduct, bullying, harassment, or inappropriate behavior between participants.

The Club reserves the unrestricted right to remove any Participant from activities at its sole discretion, without refund.

  1. No Guarantees of Results

The Club makes no guarantees regarding: skill improvement, performance, competition results, ratings, titles, or rankings, selection, advancement, or future opportunities.

Participation does not create any entitlement to outcomes.

  1. Tournaments and Competitive Events

The Club bears no responsibility for: tournament outcomes or results, pairings, rankings, ratings, decisions of arbiters or organizers, disputes, penalties, or disqualifications.

All competitive decisions are final and binding.

  1. Third-Party Venues and Services

Activities may take place at third-party venues or involve third-party service providers.

The Club assumes no responsibility for:

  • venue safety or conditions
  • compliance standards
  • security or emergency procedures
  • acts or omissions of third parties

Responsibility for premises safety rests exclusively with the venue operator.

  1. Transportation Disclaimer

The Club is not responsible for transportation to or from activities unless explicitly agreed in writing.

All travel arrangements and related risks remain the sole responsibility of the Guardian.

  1. Payments, Fees, and Refund Policy

All fees, payments, subscriptions, and charges are final and non-refundable under all circumstances.

No refunds are provided for absences, cancellations, schedule changes, or removal due to disciplinary reasons.

  1. Photography, Video, and Media Rights

The Guardian grants the Club a perpetual, irrevocable, worldwide, royalty-free right to:

  • photograph and record the Participant
  • use, reproduce, edit, store, publish, and distribute such media

Media may be used on websites, social media, marketing materials, and communications without compensation.

The Club is not responsible for third-party reuse once content is published.

  1. Intellectual Property

All training materials, methodologies, content, documents, videos, and intellectual property are the exclusive property of the Club.

No materials may be copied, distributed, or reused without prior written permission.

  1. Online Platforms and Digital Content

The Club is not responsible for: user-generated content, platform outages or data breaches, unauthorized copying or misuse of content.

Online interaction occurs entirely at the user’s own risk.

  1. Data Protection

Personal data is collected for administrative and operational purposes only.

Reasonable safeguards are applied; absolute security is not guaranteed.

Data may be shared with third parties when required for legal, operational, or event-related purposes.

  1. Compliance With Laws

The Guardian is responsible for ensuring compliance with all applicable laws, regulations, and rules related to participation.

  1. No Partnership or Agency

Nothing in these Terms creates a partnership, employment, agency, fiduciary, or joint-venture relationship between the Club and the Participant or Guardian.

  1. Modifications to Terms

The Club reserves the unilateral right to modify these Terms at any time.

Continued participation constitutes acceptance of the updated Terms.

  1. Force Majeure

The Club may modify schedules, locations, staff, or cancel activities due to circumstances beyond its control.

No liability or compensation arises from such changes.

  1. Dispute Resolution and Arbitration

All disputes shall be resolved exclusively through binding arbitration.

The Guardian waives the right to: court proceedings, jury trials, class actions.

Arbitration decisions are final and binding.

  1. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions remain fully effective.

  1. Survival

Provisions relating to liability, indemnification, media rights, intellectual property, and dispute resolution survive termination of participation.

  1. Entire Agreement

These Terms constitute the entire agreement between the parties and supersede all prior communications or understandings.

  1. Governing Law

These Terms are governed by the laws of the jurisdiction in which the Club operates.

  1. Language

In case of any discrepancy, the English version of these Terms shall prevail.

  1. Final Acceptance

Registration confirms full acceptance of these Terms and Conditions and agreement to be legally bound.
